Woman Charged After Public Sex Act in McDonald's Parking Lot

Krystal Payne was arrested by Martin County Sheriff's Office deputies on January 15, 2024, after a witness reported a couple engaged in sexual activity in a McDonald's parking lot in Palm City, Florida. A passerby recorded video of the incident and called 911, prompting the police response.

When deputies arrived at the scene, they found Payne nude from the waist down in the driver's seat of her GMC Denali. Her companion, Michael Herbert Biddle, was fully clothed. The two individuals identified themselves as business partners, and deputies learned that Biddle is married, though his wife was not present during the incident.

During questioning, Payne admitted to the sexual activity, telling deputies "Yes, of course we were." Biddle denied the allegations, stating "We didn't have intercourse, trust me." The conflicting statements led to an extended investigation at the scene.

Deputies spent approximately 45 minutes determining appropriate charges for the incident. They considered felony charges but determined those required a witness under 16 years of age. Although the initial complainant believed children on nearby sidewalks may have witnessed the act, deputies could not confirm that any minors actually saw the incident.

The Martin County Sheriff's Office ultimately charged Payne with disorderly conduct, a misdemeanor offense. Biddle was not charged in connection with the incident. The case demonstrates the challenges law enforcement faces when determining appropriate charges for public indecency cases based on witness testimony and available evidence.
