Mother Charged After Leaving Child in Car Outside Bar
A Florida mother faces felony child neglect charges after leaving her minor child sleeping in a parked car outside Smiley's bar while she went inside to join her husband. Ms. Finnegan was charged under Florida Statute 827.03(2)(D) following a law enforcement response to a 9-1-1 text report about the child left in the vehicle.
According to court documents, Finnegan arrived at Smiley's at 9:53 PM and parked directly in front of the entrance. Her child, Michael, was asleep in the car with the air conditioning running. The timeline shows Finnegan received her first drink around 10:00 PM and took her first sip at 10:03 PM.
The defense filed a Sworn Motion to Dismiss the charges, arguing that the undisputed facts do not establish a prima facie case of guilt. The motion emphasizes that the child was checked on multiple times during the incident and was never observed to be in distress. Defense attorneys contend that Michael remained comfortable and sleeping with the air conditioning running throughout the timeframe in question.
Law enforcement officers responded to the scene after receiving the 9-1-1 text alert and found the child in the vehicle. Finnegan's husband was initially charged with child neglect in connection with the incident, but prosecutors later dropped the charges against him.
The case highlights ongoing legal debates about what constitutes child neglect when parents leave children unattended in vehicles, even when safety measures like air conditioning are in place. Finnegan currently faces the single felony charge of child neglect.
